Lawyers seek evidence preservation after failed Tennessee execution

Attorneys are set for Wednesday court proceedings to preserve evidence from a botched lethal injection, days after President Trump cleared a firing squad for the Fort Hood shooter from 2009.

The inmate's legal team has a Wednesday court date and intends to ask the court to retain evidence from the botched procedure.

The state's attempt involved lethal injection, and the procedure failed on two occasions.

The inmate survived the state's attempt last week.

After President Trump cleared a firing squad for the Fort Hood shooter from 2009, Tennessee had already been unable to complete a lethal injection.

The inmate's attorneys said Tuesday that the inmate was conscious, able to talk, and under hospital care.

The legal team was also scheduled for a press conference, one week since the failed procedure.

The failed procedure helped prompt public discussion about the death penalty.

The inmate received two injections during the state's unsuccessful attempt.
